MI3.4 EyeGaze Naviagtor does request, store or process any users personal data, making the Application GDPR compliant.
This Application End-User Licence Agreement (EULA) document has been crafted to safeguard our intellectual property.
Definitions

Agreement:Refers to this End-User License Agreement, constituting the comprehensive agreement between You and the Company concerning the Application's usage.

Company:Pertains to MI3.4 EyeGaze Navigator. Also denoted as ‘We’, ‘Us’ or ‘Our’ throughout this agreement, it represents Sarah Chaudhary, Aleeyah Kadri and Baicheng Yin.

Application:Encompasses software(MI3.4 EyeGaze Navigator) developed by Sarah Chaudhary, Aleeyah Kadri and Baicheng Yin, downloaded by You onto a Device. Content: Denotes all material such text, images, or other data that You can post, upload, link to, or otherwise make accessible, irrespective of its form

Device:Encompasses any tool capable of accessing the System, such as a laptop or desktop computer.

Third-Party Services:Refers to any services or content, including data, information, applications, and other products/services provided by a third-party, potentially displayed, incorporated, or made available by the Application.

You:Represents the individual accessing or utilizing the Application, or the company, or any other legal entity on whose behalf said individual engages with the Application.
License

Scope: We grant to you a non-transferable, non exclusive limited licence to download, install and use the Company Application strictly within the terms of this Agreement.

Restrictions:You agree to not alter or obscure any proprietary notice of the Company and those in which it is affilated.
Third-Party Services
The Application may include third-party content and links to third-party websites or services. You acknowledge that the Company is not responsible for any Third-party Services, including their accuracy or legality. The Company disclaims any liability for Third-party Services, and You must adhere to their terms when using them through the Application. Third-party Services are provided for convenience, and You use them at your own risk, subject to third-party terms.
Support and Updates
The Company may, under no obligation however, provide updates to the Application or offer support.
Limitation of Liability
Regardless of any damages incurred, the Company's and its suppliers' liability under this Agreement is limited to the amount paid for the Application. To the fullest extent permitted by law, neither the Company nor its suppliers are liable for special, incidental, indirect, or consequential damages, including loss of profits, data, or interruption of business. This limitation applies even if the possibility of such damages has been advised. Some jurisdictions may not allow the exclusion of incidental or consequential damages, thus this limitation may not apply to You.
Indemnification
As part of this agreement, You consent to indemnify and protect the Company, its parents, subsidiaries, affiliates, officers, employees, agents, partners, and licensors (if any) from any claim or demand, including reasonable legal fees, resulting from or related to: (a) your use of the Application; (b) your breach of this Agreement or any applicable law; or (c) your infringement of any third-party rights.
Limitation of Liability
Notwithstanding any damages that You might incur, the entire liability of the
Company and any of its suppliers under any provision of this Agreement and your
exclusive remedy for all of the foregoing shall be limited to the amount actually
paid by You for the Application or through the Application. To the maximum extent permitted by
applicable law, in no event shall the Company or its suppliers be liable for any special,
incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages
for loss of profits, loss of data or other information, for business interruption, for personal
injury, loss of privacy arising out of or in any way related to the use of or inability to use the
Application, third-party software and/or third-party hardware used with the Application, or otherwise
in connection with any provision of this Agreement), even if the Company or any supplier has been
advised of the possibility of such damages and even if the remedy fails of its essential purpose.
Some states/jurisdictions do not allow the exclusion or limitation of incidental or consequential
damages, so the above limitation or exclusion may not apply to You.
Warranty Disclaimer
The Application is provided "AS IS" without warranties. The Company disclaims all guarantees, including performance and reliability. You acknowledge that the Company isn't liable for any issues.
Severability
If any part of this Agreement is deemed unenforceable or invalid, it will be modified and interpreted to fulfil its purpose to the maximum extent allowed by law, while the rest of the Agreement remains valid and enforceable.
Changes to this Agreement
The Company reserves the right to amend this Agreement anytime at its discretion. If there's a significant change, we'll give you 30 days' notice. Your continued use means you accept the changes; otherwise, you can't use the Application anymore.
Entire Agreement
This Agreement represents the complete understanding between You and the Company concerning your use of the Application, replacing any previous written or verbal agreements. Additional terms and conditions may apply to your use or purchase of other services offered by the Company, which will be provided to You at the time of such use or purchase.
